1. Merchant of Record
Keeppicks acts as the official Merchant of Record (MoR) for all transactions on this platform.
When you purchase content, you are purchasing it directly from Keeppicks, not the individual creator.
Your payment method will be charged by Keeppicks, and this name will appear on your bank or credit card statement.
We hold the distribution rights to sell this content to you on behalf of the independent creators using our platform.
2. Payments, Sales Tax, and Subscriptions
Taxes: As the MoR, we are legally responsible for calculating, collecting, and remitting applicable Sales Tax, VAT, and GST based on your billing address at checkout.
Subscriptions & Click-to-Cancel: In compliance with FTC Negative Option Rules, any recurring subscription will clearly state the billing interval before purchase. You can cancel any active subscription online at any time through your account settings with a single click, just as easily as you signed up.
3. Refunds and Chargebacks
Refund Policy: All refund requests must be routed directly to Keeppicks at support@keeppicks.app. Individual creators cannot issue refunds.
Chargebacks: Fraudulent or unrecognized chargebacks filed through your bank without contacting our support team first will result in the immediate and permanent termination of your account and loss of access to all purchased content.
4. Creator Content and Liability
Independent Contractors: Creators are independent individuals and are not employees or agents of Keeppicks. We do not endorse, guarantee, or assume liability for the accuracy, quality, or safety of the digital content they upload.
DMCA & Acceptable Use: We strictly prohibit the sale of illegal, non-consensual, or copyright-infringing material. We reserve the right to remove any content and terminate creator accounts that violate our Acceptable Use Policy.
5. Creator Payouts & Tax Reporting (For Creators)
If you act as a Creator on our platform, you agree to our separate Creator Agreement. You acknowledge that we collect payments on your behalf.
Before receiving payouts, you must complete KYC/KYB identity verification and provide a valid W-9/W-8BEN. We will issue IRS Form 1099-K to creators who meet the applicable federal reporting thresholds (e.g., $20,000 and 200 transactions for the 2026 tax year) or state-specific thresholds.
